From the article... "So, to recap: EULAs are binding, they can control just about everything you might dream up, and only Congress can change the situation." So what about EULA's that can't be read until after opening the software package? Are the courts prepared to over turn store policies prohibiting refund for anything short of product fail? "We hold today that a software user is a licensee rather than an owner of a copy where
Let's suppose the game was bugless and worked (HAHAH) ...Hey I love this game so forgive the irony please - and start talking about its strategic faults:
I see no irony. I do see what appears to be malicious sarcasm. That's how I read your title and opening sentence anyhow. If you just wanted to talk about exploits, why the disrespect?
Your being an ass Zero. Your attacking the forum members with generalizations. And your attacking Stardock with assumptions. I've seen no constructive purpose with your recent postings. Be free to offer advice and feedback on the game. But please stop the negativity.
In this forum, you either kiss stardock's ass or you are told to "shut up and go away" by half dozens of truculent thread-guard fan boys. If you read some random posts about the game, you will be capable to name each one of them.
Your statement is patently false. I take exception to it. People who love the game offer feedback. People who are disappointed offer advice. People who are outrigh
Shrug, so shifting blame around? Doesn't help the situation or future purchases or recommendations of games.
Wheres the blame shifting? I think it occured by flaming Stardock for actions outside their sphere of influence. Stardock doesn't ship the games. They have no control over shipping operations. And they are limited in response by the quality of the intel they are gi
Well blame depends. Who gets most of the money from my pre-order?
I think people have a reason to be upset. I just wanted to highlight the fact that shipping errors are not of Stardocks doing. And the info they get on whats been shipped is provided to them by the fulfillment vendor. They don't have direct control over any of this. Therefore there
I think there is a lot going on here with this phenomenon. A lot of different needs are being met by a lot of people. We are learning what bothers us and what doesn't, what hurts others feelings, what this kind of hurt feels like, how to defend others, how to rise above and sink with bitterness. Nerdraging is behovely, and everybody involved is getting something useful out of it.
Agreed. I find this all intriguing.
That really sucks. But you should know that Stardock, like many ( most? ) companies use a Fulfillment vendor to manufacture, assemble, and ship their product to the end user. This is a third party company with no relation to Stardock services. Stardock is a customer. They pay the fulfillment center to burn the CDs, package the games, send the product to the

You would have seen a lot of reviews using phrases like "Despite these problems..."
I've similar thoughts. And wonder at the ferocity for which Elemental was hammered. "Why I chose Elemental over Civ 5" I initially choose Elemental over Civ5 because I choose Impulse over steam ( thats a whole other topic discussed in length elsewhere, so I won't get into here ). 2k's handling of Civ reinforces my decision to abandon my most favored game. Stardock as a publisher is everything that 2k is not. From this gamers pov..

I.e. If you're emotionally attached to a product, you're too close and clearly, obviously, I was too close to it.
I've read you saying this a few ti

I'll quote the "right" in question. "Gamers shall have the right to demand that games be released in a finished state." The fact that Stardock has now taken down said "document" from their site says alot abou
There is MP, but this not a cloud game or an MMO ( if thats what your looking for )... Was just playing.... The Battle for Wesnoth !!!!!!!! Top notch game. I'da been happy paying $60+ for it. Buts it's free. Always has been. Its a gem of an open source

Often you pay a large chunk of the job cost to cover materials at the very least. @ some... First off, I'm one who feels strongly that a product purchased must do the job immediately. However, the software environment in general, seems to currently be based on a post release fix-it somewhat paradigm. But by default I don't trust in a companies willingness to improve product post sale. Yet, from researching Stardocks history, I grant them a bit of a window based on historic performance. Some say that Elementals start was a little rocky. Stuff happens. It is an ambitious project with many complicated parts. On the whole, Elementals launch is an ever growing success. The parts that need refinement are being addressed in an especially timely manner. Hats off to the Elemental crew for their dedication to the game and its fans. They keep us updated. They dialogue with us about the game. They work extended hours to provide fixes AS
