If the ability to settle comes from choosing Path of the Governor, then they will be even more OP (depending on what resource you need to train them, now that Influence is gone). You can get the free copy of FE only from Stardock directly. Go over to their store-page , log in, and look under 'My Downloads'. You should find it there, if you are eligible.
Did you start a new scenario or are you continuing a previous one? If you continued an old save, you will have to start over. I just verified in-game, that the missing production yield is fixed in 1.32, but the fix can't get applied retroactively to an existing save-game. Still, you could also use rush-buy to get all the improvements you need. Research Civics to get the ability to rush production, and wait until you have enough Gildar. This will take some time, but it should work.
I may be wrong about this, but changing 1 to 0 for Generic_Henchmen in CoreUnits.XML should do the trick for Henchmen. However, I don't know what other repercussions (like inability to use equipment) this might have.
From what I remember, the discount was for people who bought E:WoM in 2011. However, you only get the discount if you buy FE from Stardock directly, not through Steam.
Just wait until the alliance treaty runs out. It works for 99 turns, if I'm not mistaken, and ends automatically once the time is up. You could also use Curgen's Volcano to end the game. Find the enemy sovereign and cast CV on him/her. This will automatically kill the sovereign (no respawn) and end the game for you. Well, you could probably consider this an exploit, because CV isn't supposed to do that, but the choice is there.

To make screen shots, just press Print Screen. You can then find them under My Docs\My Games\FallenEnchantress\ScreenShots. Regarding the inability to build anything, you are most likely too close to another city. There is a minimum distance of 4 tiles for city improvements. Same goes for the city center itself, but that depends on the size of the map. 5 for tiny maps, 6 for small and medium maps, and 7 for large maps.
