Agree with OP and also agree with Heavenfall's take on the map size dictating some item levels.
I had an outpost next to a city and then the city was destroyed by wandering monsters. I didn't lose the territory the city was on because of the outpost and so was able to rebuild the city again. Not that I like the game mechanic of permanently losing the grain and materials after a city is destroyed.
I've noticed that outposts now have precedence over cities with regards claiming territory. I'm assuming this is a bug. In one game I built an outpost on the border of an AI city and claimed all the resources he had secured.

Thanks again for the comments. :) At this stage in the game Gilden is a reliable ally and is at least causing difficulties for Yithril. Yithril is still sending troops past and attacking but I assume there are also a number of battles going on in the fog of war. Besides that, sending an army south would mean either leaving the west undefended of my capital undefended. Feel it is best to secure the capital and work in the west at this point in the game. Thanks Naaarf. I put myself in the noob category for most games I play and making mistakes is what I do well. :) I didn't ever play MoM but played AoW an awful lot. The initial placement of armies was on a much larger battlefield and being hex based allowed the units to form a row. The only issue was if your unit was at the wrong end of a row. And if you attacked a city, the city always went first and the units in the city had completely free movement to get into a defensive posit

I like the idea of tying defensive starts (or lack there-of) to the Assassin path. Also using initiative as a basis for starting battles in defensive mode is a good idea too. Fallen Enchantress is already a very enjoyable game that just gets better and better.

The animation isn't stalled. It is the animation of the Earth Elemental crawling out of the ground. It probably only goes for 4 seconds at the start of the tactical battle but the UI makes you think you can have your first turn.
