I'm not sure yet about your detailed morale suggestion, but I completely support the two basic premises you mention. "Fighting to the death" is something that annoys me in many strategy games too and I would really like one where a defeat does not mean the utter destruction of the losing side almost every time. I also suppot giving running water greater meanig (above a food bonus or alike).

I dont see what the big deal is. MoM was a great game no doubt, but the fantasy setting was pretty generic. What made MoM great was successful design of game mechanics and pacing... something that has little to do with a license.
