I didn't have problems with the faction generator, although I only made one kingdom, so dunno about empires. The tech tree is looking as it should be.

Thanks of the "day o" patch. I have waited for a game like this since... well since master of magic.

Same hapened to me, it seems like tactical battles are only for the campaign. I haven't played much yet so it may be posibble it is tied to a technology, but I doubt it.
