Yeah, double strike can't miss (gamblers strike can, but that's because it uses another system entirely that we can't use for double strike).
Changing it would require a new feature to be added to the combat system (addition of a can hit check on spells), which I'm not going to do for FE (it would introduce its own bugs and issues so its not worth it for one ability). Instead I'll update the desc to what it actually does and increase the cooldown.
