Dear Mr. Tereschenko

When looking through your Opera skins I was appalled to find that you had taken the works of other artists and used them in your skins without permission. The graphical elements in question that you took specifically are the Copyrighted Fauxs-xp icon sets, Copyrighted Copper Deck 2 Icons and Windowblinds skin graphics, Copyrighted Sputnik Icons and Windowblinds skin graphics, icons from the Author Foood, premium skin suites that bring in revenue for skin authors and artists, and theft of copyright from other places that I can not completely verify at this time. More shocking than any of your any of your other actions was the use of premium skin suites from Stardock, and Pixtudio.com. The Images from the Orion icon set, and the Toon-XP premium suite are copyrighted material and not for redistribution. You have clearly violated the license agreement on those files and you may be sued by Stardock and Pixtudio for damages. I am asking you to remove the skins in question, and if you would like to put these skins back online please contact the authors for permission to use their graphics. I am forwarding a copy of this email to Opera, Pixtudio, Wincustomize, and Stardock. Thank you for your time, and I await your response

Actually yeah it was snipe Iplural. But so was what jafo said. Maybe the way I wrote that one sentence wasn't totally clear but it's intent was in the sentences that followed. I'm not sure what address everyone is sending their complaints to when your emailing opera but a better place to put your complaints might be their message board. http://my.opera.com/forums/
I know the sales and technical support are in the messege board alot and there is a topic on customizing opera there.

i have recieved 2 emails back from this gentleman... he states that he has permission from mormegil and food to use the icons... and he says he is trying to get permission from Alexandrie, and Treetog... here are the emails...

Dear Andrew Dzieman.

Answering your letter I can tell the following.
1. I have received the sanction from author FauxS icons the sanction to use of his images.
2. I have apologized before author CopperDeckII and Sputnik for use without the permission
of him icons and asked of the sanction to this use. Now I wait the answer.
3. I do not render the loss to all people listed by you. All products listed by you are
distributed free-of-charge. Except for Orion and Toon-XP.
But also to authors of these styles I do not bring the loss and even on the contrary -
I promote rise of sales of their products. I have not made skins for programs Stardock.
And I did not see skin for Opera 7 made by all listed authors. Programs Stardock are not
widely known among users. Offering the skins I create advertising to these products.
4. I do not sell these skin! I do not receive any commercial benefits! I have specified
authors of the used products. I only want that people could take pleasure at work with
the favourite program.

Just wondering... he seems like a nice enough guy... hmm... the only thing is his use of Toon-xp, and Orion... The policy of these skinners is NOT to give their permission AFTER the fact....ONLY 'before'.
Ask first and generally consent will follow.
Fail to ask and REFUSAL is guaranteed.

I emailed Opera....and have not received a response as yet...but will continue to demand the work is removed as it is a clear theft of property rights, pursuable in Law.

RuderThenYou....I do not jump down everyone's throats...but likewise I do not think praise for a ripper's 'skill' is warranted, either....certainly not on a skinning site...perhaps on a warez one that matches the mind-set of the thief.
I spend more than just a little of my time chasing down creeps like this one who are quick to take claim for others' work and defend it with every lame excuse imaginable.
His are nothing new, nor are they valid.

Seeing as ToonXP is actually purchased I don't see the authors allowing anybody to give it away for free, I purchased this product and completely disagree with any person that would give away for free work that someone has spent time (and possibly money) on.

This person should stood against a wall and shot - Severly of course.

I left a message on Opera's website, since no email address was available... but I mentioned the skinner and asked also that his skins be removed... I tried to emphasize the fact that Toon xp is a copyrighted product that is sold, as well as Orion.

To Volter.....

It appears that you are displaying numerous images and skins on Opera.com originally created by authors other than yourself.
Although images are freely available for download on the Internet, they are EXPRESSLY for PERSONAL USE, which does not include the reproduction and redistribution of them via another site such as this.
The modification, and/or re-distribution of an artist's images without his/her express permission is in violation of the Artist's Copyright, and is pursuable in law.

Whether these images link to the original artist's site or not, or whether the Original artist is credited or not, without PRIOR PERMISSION to display such, you are in violation of inherent and/or expressed copyright.

In particular, some of the images you have STOLEN are from themes which are sold to the public and are NOT free. These are therefore examples/instances of PROPERTY THEFT and not just Copyright theft.

I strongly suggest you remove any such images for which you do not have permission to display via verification of author, and minimize the potential for litigation against you and subsequent claims for loss.

I await your favourable response.

Your English is quite good.

However the images you have used are not yours. They belong to other people who drew them themselves.

If you do not ask to use them it means you steal them.
It is as simple as that.
If you see a car in the street you cannot just take it and explain you wanted to show the world how nice a car it is.
It is not yours to take.

treetog and Alexandrie are two who have not given you permission.
That means you MUST remove those images.
As I said, giving credit is not good enough.
That is like....
I STOLE YOUR CAR BUT I PUT YOUR NAME ON IT SO EVERYONE KNOWS IT IS YOURS...BUT I WILL NOT GIVE IT BACK TO YOU.
You need to learn about Copyright Law. It is protected by International convention.

Do you think you would be allowed to use the CocaCola logo without permission? No, you would not, and their lawyers would tell you soon enough. The same applies to any and all graphics images artwork icons unless specific consent is given.
In the case of Alexandrie - treetog - Pixtudio.com this permission WILL NOT be granted.

Please have those images removed immediately.
Do NOT try to wait for consent/approval. It will NOT come.

Any of the authors listed by you has not created any skin for this

To create a skin for Opera 7 it is not easier than for WB.
And nevertheless I have sent the letter to authors with the offer to
publish my skins under their name. But yet has not received the answer.

I do not know about which authors you speak in the letter. But I can tell that
from the some people I have received the consent to use of their works.

I think so. When the artist creates a picture - he wants that the world around
became little bit better. I think that to the artist should be pleasantly know
that his hard work is claimed. I at all have not infringed the right of artists.
On the contrary - I everywhere specify authorship of the images used by me.
To accuse me of larceny at you there are no bases. I agree that my
skins were distributed under other name on a condition that it will be
free-of-charge.
If authors will demand to remove skin with their images - I shall remove!

And still think - whether such good advertising of those which products of the
image I is necessary for you used in the skins.

I hope he removes all of his themes... unless mormegil gave him permission... which i doubt he would do for Toon, and Orion, if he can... hmmm... this may get ugly... if he does not disarm all weapons of mass... i mean ug... delete all of his rips then we will have no choice but to take him out... he he he..

I've been gone too long. I just checked. copperdeck he did get rid of. But he still has the other stuff. He edited the title with the e-mail address. Plus changed his name. Interesting. I had to check on this since I stuck it up. If you want to, you can let it slide again.
