I believe your race has to be a Kingdom race.

Not your sovereign's race, but your people's race.

I don't have the game in front of me right now. Does the tool tip for Life magic state that? And conversely death?

No, it doesn't. Actually, it's kind of obscure.

It does not explicitly state that in-game as far as I've seen.  However, if you make a custom sov, you will notice that kingdoms get life magic, and empires get death magic.  Although I'm sure Frogboy and others will quibble with this, kingdoms are good and empires are evil, hence the magic option limitations.

It's part of the lore, rather than under a tooltip.  The kingdoms have access to Life spells, and the empires have access to Death spells.  Assuming you give the appropriate book to your sovereign at setup, or you luck into finding a champion who has it.  There are usually several champions with Life and Death books in every new game, though I wouldn't count on that if you set champions to sparse under Options.

I don't think you can change the race of your sovereign except choosing his "Faction" to represent, which in terms also decide if he is Kingdom or Empire.

 

I have for a loong time wished and asked for upgraded user interface for custom sovereign and custom factions, but seemingly you have to know half the game mechanics to know what is going on in there :)
