Demanding surrender / AI not agreeing to surrender

What determines when AI would surrender to the player?  In my current game I have one of the AI players down to one tiny army (made up of sovereign + few heroes), no cities and he still does not surrender (need the AI sovereign to sacrifice to get get Death magic )

You should have an option in the game configuration screen that determines how easily the AI will surrender.

I have it the opposite. Entire nations just drop the game saying 'it's too hard for them'. 3, 4, 5 cities and they're all just quitting.

I had the same problem. One quit when they were the most powerfully rated empire with around 10 cities left. I mean they were going to lose, but they shouldn't have been able to know it at the time. I was playing on Challenging with otherwise standard settings. Large map.
