As shown, I could not actually build an Earth Shard despite any other evidence to the contrary.

Is the Earth shard located at 2 squares of the center of your city while your city is level 1 ?
Thats what the screenshot shows, although I have noticed that the resource based buildings show up a non-greyed even when they are out of range.
I found that I had to have a city reach level 3 before it would allow me to build a Shard.
What was the distance between the center of your city and the shard?
I have had this with Oasis Tiles built my city right beside them and at least 2 times i can think of was not able to build on it.
